Drug Possession Defense Strategies
There are a number of ways to fight a drug possession
case. The state has to prove that:
- The substance was actually yours, or in your
possession
- That the police had the right and probable cause to
search your person or property
- That the substance is tested and actually an illegal
drug
...and more. The motions I file will depend on the
particular facts and strengths of your case. But I'll make
sure to fight every element beyond a reasonable doubt.
If I don't think there is a good chance to beat the
case, or if you are not comfortable with fighting the
case, there are usually good options to settle the
charges. Often lesser penalties can be negotiated, such as
drug treatment programs. With more serious charges, we may
be able to negotiate house arrest instead of jail time.
