Help! I've Been Arrested! What Do I Do Next?

First, don't panic. There are a lot of steps to go through, and many opportunities for us to assert and defend your rights as a defendant. In all criminal cases, the burden of proof is on the prosecution. 

Simply put, the prosecuting DA must prove that 1) a crime was committed, and b) you committed it.

That may sound simpler than it actually is, especially if we can challenge any or all of the steps along the way, such as:

  • Did the police officer follow proper arrest procedures?
  • Were you identified as a suspect legally and properly?
  • Were you were properly advised of all your rights according to the law?
  • Was any search conducted in accordance with all the laws of the state and federal government?
  • If there were any any scientific tests conducted, were they fair, accurate and done in a recognized, standardized way by experts in the field?

I'll also file motions for discovery about any evidence the prosecution may have that could prove or suggest your innocence! There may be police videotapes, or other information that could help our defense.
